Islamabad: Election Commission of Pakistan (ECP) on Friday issued a notice to the Pakistan Tehreek-e-Insaf (PTI) on amendments to its constitution, directing the party to submit a copy of the amended constitution.
Sources aware of the development said that PTI changed the party structure after amending the party constitution, fixed a formal procedure for issuing party tickets.
The election watchdog took this decision in a meeting held to discuss the chairmanship of the party.
Last week, the ECP took steps to initiate proceedings to remove Imran Khan from the post of PTI chairman in light of the election watchdog’s verdict in the Tosha Khana case, which accused the former prime minister under Article 63 ( 1)(p) was disqualified for making a “false”. A notice has been issued to the former prime minister and the hearing of the case has been fixed on December 13. However, the PTI asserted that the law does not bar a criminal from becoming an official of a political party.
According to Section 5(1) of the now defunct Political Parties Order (PPO) 2002, “Every citizen shall have the right to form or become a member of a political party or to affiliate with a political party or to participate in political activities. Activities or being elected as an officer of a political party: Provided that no person shall be appointed or serve as an officer of a political party if he is not qualified to be, or is ineligible to be elected or elected. declared.as a member of the Majlis Shura (Parliament) under Article 63 of the Constitution of the Islamic Republic of Pakistan or under any other law.
It should be noted that after the disqualification of Imran Khan, the petition to remove him from the post of Chairman PTI is already pending in the Lahore High Court.
The petition stated that as per the Representation of the People Act 1976 and the Political Parties Order (PPO) 2002, it is a legal and constitutional requirement for party office bearers to be qualified as per Articles 62 and 63 of the Constitution.
It said that after Imran’s disqualification from constituency NA-95, it was “only” that he should be de-notified as PTI chairman and an order issued in this regard.
