A day ago, Additional Sessions Judge Zafar Iqbal rejected the request to suspend the non-bailable arrest warrant of the former prime minister in the Tosha Khana case.
Khan, in a petition filed at the IHC, sought suspension of his arrest warrant. He also demanded an urgent hearing of the application today.
Despite the non-bailable arrest warrant issued against him in the Tosha Khana case, the ousted prime minister has not yet appeared in the session court of Islamabad.
At the beginning of the hearing, Imran Khan’s junior lawyer Sardar Masroof Khan appeared in the lower court. Meanwhile, Pakistan Muslim League-Nawaz (PMLN) leader Mohsin Shahnawaz Ranjha and Election Commission of Pakistan (ECP) lawyer Saad Hassan also appeared in the court.
Additional Sessions Judge Zafar Iqbal inquired whether Imran Khan will not appear in court again today. The lawyer said that it is not known whether Imran will appear or not and the senior legal team of the PTI chair will appear in the court at 10 am. After which the court adjourned the hearing till 10 am.
When the hearing resumed, ECP’s counsel Hasan requested the court to adjourn the hearing till March 9 as Khan is present at the IHC.
Ranjha supported the plea of the lawyer and said that the PTI chief will definitely appear in the High Court on March 9.
However, Khan’s lawyer maintained that he was informed that it would be easy for the former prime minister to appear in court next week.
On this, the judge remarked that in other words, this means that Khan will not appear in the sessions court on March 9.
The judge directed Khan’s lawyer Sher Afzal Marwat to file an affidavit. On this, the lawyer assured the court to submit the document by 11 am.
The judge remarked that it seems Imran Khan will not appear in court again today.
Later, the court adjourned the hearing till 2 pm on the request of Khan’s lawyer.
On Monday, Judge Zafar Iqbal rejected Imran Khan’s request to suspend the arrest warrant while pronouncing the verdict.
In the judgement, a copy of which is with JEE News, the judge said that Imran had not challenged the arrest warrant issued against him in any forum. The accused was in a position to appear in this court on February 28 after appearing in other courts, but he deliberately avoided appearing in this court.
“The warrant shall remain in force until it is canceled by the issuing court or until it is executed in accordance with Section 75(2) CrPC,” the court order said. It said that a warrant had been issued for Imran’s appearance in the trial, but noted that the PTI chief was not present in the court even on Monday.
Last week, the court issued a non-bailable arrest warrant for PTI chief Imran Khan while he was appearing in three other cases related to embezzlement, terrorism and attempted murder filed against him in other local courts.
