The National Assembly adopted a categorical stand that the House rejects the three-judge minority decision and declares that the four-judge majority decision, which is in accordance with the Constitution and the law, is enforceable.
Prime Minister Shehbaz Sharif was also present in the House when the resolution was passed by majority vote. The resolution was presented by Khalid Hussain Magsi of Balochistan Awami Party. Through the resolution, the House expressed its concern over judicial interference in political matters and supported the election of all assemblies on the same day under the constitution and law for economic and political stability in the country. The resolution said that the House believes that this is the only solution to the crises facing the country at the moment.
The House pointed out that an earlier resolution passed on March 28 upheld the four-judge majority verdict and called for its implementation. The resolution said that in the resolution passed by the House on March 28, the judiciary was also demanded to refrain from unnecessary interference in political and administrative matters, while various circles also demanded to make a full court reference, but no one responded to this demand. The House also expressed deep reservations over the misinterpretation of Article 63-A of the Constitution, rewriting it through a Supreme Court judgment and demanding that a Full Court Bench review it. Opposing the resolution, PTI MNA Mohsin Leghari warned that the House was committing “collective contempt of court”. Leghari was the only member who opposed the resolution in the House.

The PTI leader while passing the resolution said that the House is collectively committing contempt of court. He warned that a ‘battle’ with the Supreme Court would be very dangerous and added that the proposed resolution should be passed after rational deliberation and not in the flow of passion. Defending the Supreme Court’s decision, the PTI leader said that the apex court had only announced to hold elections within 90 days as per the Constitution.
He further said that PTI was not given an opportunity to speak and present its case before voting on the resolution. Leghari protested and said that the opposition should be given a chance to speak as per the democratic tradition. He said that 90% of the business of the House is based on criticism of PTI Chairman Imran Khan. “Though Imran is not in the House, he is on everyone’s mind,” Laghari declared, as other PTI members protested the resolution.
Earlier, Minister for Communications and JUIF Parliamentary Leader Asad Mehmood alleged that the judiciary was facilitating an accused, who did not bother to attend the court proceedings. He also rejected talks with Pakistan Tehreek-e-Insaf (PTI) at any forum and demanded a judicial inquiry against Imran Khan for violating the constitution.
People’s Party Member of Parliament Shazia Marri also criticized the decision and said that the controversial decision was announced in a few minutes while the reference against the judicial killing of Zulfiqar Ali Bhutto has been pending in the Supreme Court for the past 12 years.
Leader of Opposition Raja Riaz said that the verdict was pronounced for the convenience of an individual, it will be remembered as a dark chapter in the country’s history.
APP added: Prime Minister Shehbaz Sharif said that the government will accept the decision of the full bench of the Supreme Court for elections in Punjab and Khyber Pakhtunkhwa only. While addressing the foundation stone laying ceremony of Islamabad Lawyers Complex, he urged the Chief Justice of the Supreme Court to review the decision of the three-judge bench and to constitute a full court which will be elected after the elections of Punjab and KP Assemblies. The relevant decision will be acceptable. Government and all concerned. However, judges who had recused themselves earlier should not be made part of this bench, the Prime Minister said. He recalled that Justice Munir was the creator of the doctrine of necessity which took Pakistan in a certain direction. We respect the Supreme Court and the judges and their decisions should apply to everyone.
Regarding the Supreme Court’s proceedings in the election case, he said a nine-member bench was constituted, which was reduced to three after some judges defected. He said that despite requests, political parties were not made a part of the process.
The Prime Minister said that if the demand of the full bench of the Supreme Court was accepted, everyone would have accepted the decision.
Moreover, the decision of Supreme Court judge Qazi Faiz Isa in one case was annulled by circular, Shahbaz said. Then a six-member larger bench was constituted for the same case. He added that Article 63A of the Constitution was rewritten and the appeal filed by the government in the Supreme Court is yet to be heard.
The Prime Minister said that no political party can avoid elections as it will bury its politics. He said that on the one hand, it was decided that the Prime Minister is nothing without his federal cabinet, but on the other hand, this principle was not applied to the courts. He said that all the stakeholders should look at their behavior and decide whether they want to protect the future of future generations or want to fight for their personal interests and take Pakistan in the direction from which it wants to go. No one can go back. We have to protect the future of Pakistan which is facing many challenges. We should take decisions with a cool mind and stay united for the interest of Pakistan. Expressing happiness over the construction of Lawyers Complex, Shahbaz Sharif said that this project will be constructed at a cost of 1.8 billion rupees.
Meanwhile, reacting to the NA resolution, PTI Chairman Imran Khan feared that the ‘tactics’ being used by the PDM government would not only direct the armed forces to the judiciary. They will stand against, but also against the nation. Writing on his social media platform, Imran tweeted, “Now it’s clear what PDM wants – some (some) way to get out of the polls. They are going to file an unconstitutional bill on the Supreme Court and against the Judiciary.” Brought the National Assembly resolution. Now a NSC mtg yesterday called for an attempt to use security as a pretext to postpone the elections. This will pit the armed forces directly against not only the judiciary but the nation.
