ISLAMABAD: Opening another front, Pakistan Tehreek-e-Insaf on Sunday wrote a letter to President Dr. Arif Alvi to refer the issue of expiry of caretaker governments to the Supreme Court of Pakistan, which in its advisory jurisdiction should address this blatant unconstitutionality and appoint administrators.

According to the letter, the letter, signed by PTI Senior Vice President Fawad Chaudhry, drew President Alvi’s attention to the “violation of mandatory constitutional orders by the federal government and the Election Commission of Pakistan (ECP)”.

Addressing a news conference here, Fawad said that the PTI will also approach the Supreme Court regarding the matter and insist on the appointment of administrators till the elections are held. I have written to the President and requested him to intervene on two issues. One issue is the extension of the ECP and caretaker governments. The caretaker governments have failed to do their primary task of holding elections in two provinces within 90 days, so the President should seek a report from the Chief Election Commissioner on this.

Fawad added that the second point was that caretaker governments were appointed for 90 days, the term of the Punjab caretaker government will end on April 22, after which the constitution is silent on who will rule the province. The term of the caretaker government of Khyber Pakhtunkhwa will end after a week.

Therefore, he emphasized, the reference should be sent to the Supreme Court, because according to the decision that has come, only the Supreme Court can proceed with the election. Automatic extension of elections is not in the constitution, so the Supreme Court should send the caretaker governments home and appoint an administrator to manage the affairs and organize the election process after April 22.

He said that if the President sends the reference, then it is fine, otherwise “we are going to the Supreme Court where we will request that Punjab be handed over to the administrator from April 23, the caretaker government should be sent home because it has expired.” then become unconstitutional.”

Under Article 224 of the Constitution, a caretaker government (which can be considered an extension of the Election Commission) has been introduced for a limited period of 90 days to ensure fair and transparent elections… After the dissolution of Punjab, the provincial assemblies of Khyber Pakhtunkhwa, A monitoring setup was established in both the provinces. However, due to the unconstitutional and illegal actions of the ECP and PDM government, the mandatory period for holding the elections within the stipulated time lapsed and the Supreme Court exercised its constitutional jurisdiction to fix the period for holding the elections. Fawad continued, “The existing supervisors, with the tacit approval of the ECP, have been allowed to venture into uncharted territories, in violation of all mandatory rules and norms of ownership, and are involved in taking important policy decisions.” , including posting and transfer of officials will affect the transparency and fairness of elections.

He pointed out that the interim set-up in both the provinces has completed its constitutional period and the constitution does not provide for continuation/extension of the fixed period for the interim set-up. In these circumstances, the interim set-ups cannot be termed legal and should be considered as “outrageous” imposed by the ECP and should be removed forthwith. “In the circumstances, it is respectfully requested that you please refer the matter to the Supreme Court of Pakistan under advisory jurisdiction to resolve this manifest unconstitutionality,” he wrote to the president.

In the news conference, he said that the recent resolutions passed by the National Assembly have no legal status and restrictions, adding that the decision of the Supreme Court is legally enforceable. Lawyers, people and political leadership stand by the decisions of the Supreme Court and these decisions will be implemented.

He said, “We are looking forward to SBP transferring the money to the ECP tomorrow (Monday). We hope that the SBP governor will do so as per his promise and elections will be held in Punjab as per schedule.”

Fawad Chaudhry took a stand that the Islamabad High Court ordered to hold local body elections in Islamabad but it was not implemented.
