Registrar of Supreme Court Returned Disqualification Petition of PTI Prime Minister Shehbaz Sharif

The Supreme Court Registrar Office on Friday returned the constitutional petition filed by Pakistan Tehreek-e-Insaf leader Andalib Abbas for the disqualification of Prime Minister Shahbaz Sharif.

In his petition, Abbasi had alleged that Prime Minister Shehbaz was guilty of breach of oath by including advertised criminals in his delegation during foreign visits.

In the petition, it was stated that Prime Minister Shehbaz exercised his powers by making the accused criminals including his son Sulaiman Shahbaz and former Prime Minister Nawaz Sharif’s son Hussain Nawaz as part of the delegation to meet Saudi Crown Prince Muhammad bin Salman on April 28, 2022. misused and violated the constitution.

Prime Minister Shehbaz along with his cabinet members paid a four-day visit to London in May this year. The petitioner alleged that during his visit, the prime minister met his brother and former three-time prime minister Nawaz Sharif to discuss issues of national and international nature “strictly related to Pakistan’s political and economic policies”. The petitioners say that during his three-day official visit to Turkey from May 31 to June 2, the prime minister once again took his son Suleiman along with his wife to attend a meeting hosted by Turkish President Recep Tayyip Erdogan. added to the delegation.

The petition accused Prime Minister Shehbaz of exchanging official secrets through an unauthorized act in violation of the Official Secrets Act, 1923.

On Friday, however, the registrar’s office returned the petition after raising objections including that “the petitioners have not identified which questions of public importance in the instant case are any guaranteed under the Constitution.” including in relation to the enforcement of fundamental rights.so as to directly exercise the jurisdiction of the Supreme Court under Article 184(3) of the Constitution.

It also states that the Prime Minister has been impleaded as a respondent in the petition, however, “he cannot be made a party under Article 248 of the Constitution of the Islamic Republic of Pakistan.”

The petition has failed to satisfy the “ingredients for exercising the extraordinary jurisdiction of this Court under Article 184(3) of the Constitution”.
