KARACHI: Senior Supreme Court judge Justice Qazi Faiz Isa said on Saturday that “it is nowhere written that the Chief Justice of Pakistan (CJP) has the authority to appoint judges”.
The remarks came during the Sindh High Court Bar Association’s annual dinner when Justice Isa expressed surprise at the behavior of the then Federal Law Minister Nazir Tarar and Attorney General of Pakistan Ishtar Ali Osaf for deviating from their previous position. expressed.
The justice, who was also a member of the Judicial Commission of Pakistan (JCP), said that the vote of a member of the commission is a trust that should be exercised without fear or favour.
He said that he was surprised at the behavior of the former Law Minister and the AGP in deviating from his earlier stand, which he had made in the Judicial Commission meeting on the promotion of High Court judges to the Supreme Court.
Justice Isa said that the constitution guarantees the right to vote to every member of the commission and that the appointment of judges should be done through deliberate and deliberate consultation among the members of the commission.
He said federal ministers used to take oath under the constitution, like judges, promising to perform their duties without fear. Yet, now they vote in the commission without giving any good reason.

Justice Isa urged the legal community to remain independent and refrain from seeking any grant from the government. He said that if the bar hopes to be independent from the judiciary, then it is likely that the bar will also be independent from the executive because the grants that the government gives come from taxpayers’ money.
He said that the bar should not request that any law minister, chief minister or prime minister provide them with assistance and be grateful to them. He said that the government funds used for transportation of government officials should be used to improve the public transport system to solve the transport problems.
Justice Isa further said that it has been seven years since Pakistan came into existence when its democratic system was attacked. He further said that the courts of that time declared this attack on democracy unconstitutional.
“The seeds of unconstitutional decisions were sown at that time, it had a negative impact on the country,” Justice Isa said, adding that in the past a prime minister was hanged under an illegal decision.

Recalling the sacrifices of lawyers and citizens for the rule of law during the lawyers’ movement, Justice Isa urged that lawyers should not forget May 12, 2007, when more than 55 citizens of Karachi laid down their lives for the rule of law. And vowed that past mistakes should not be allowed to repeat.
He said that the aim of the lawyers’ movement was not to protect the jobs of judges but for the independence of the judiciary.
Justice Isa further said that the lawyers of Balochistan also made great sacrifices for the judiciary.
