Imran Khan Disqualified in Tosha Khana Case
In a unanimous decision in the Tosha Khana reference, the ECP on Friday disqualified Imran Khan and decided that he is no longer a member of the National Assembly. The Election Commission directed to initiate criminal proceedings against Imran for false statement.
The ECP ruled that Imran Khan submitted a false affidavit and was found guilty of corruption under Article 63 (1) (p).
The ECP had reserved its decision in the Tosha Khana case on September 19 after the arguments from both sides were completed. A five-member bench of ECP headed by Chief Election Commissioner Sikandar Sultan Raja heard the case.
In August 2022, National Assembly Speaker Raja Pervaiz Ashraf sent a reference to the ECP under Articles 62A, 63A, and 223 for the disqualification of former Prime Minister Imran Khan in light of the Tosha Khana scandal.
The disqualification reference was filed by Ali Gohar Khan, PML-N’s Mohsin Nawaz Ranjha and 5 others.
The 28-page reference identified 52 gift items from the Tosha Khana received by the former prime minister, which were snatched at measly prices in violation of laws and regulations, and most of the gifts were sold in the market, including some expensive watches. were also included.
The estimated value of the gifts is Rs 142,042,100. These gifts were received between August 2018 and December 2021.
According to PML-N MNA Ranjha, Khan hid information about the gift of watches from Saudi Arabia’s Crown Prince Mohammed bin Salman in the 2018-2019 asset declaration.
Withholding information amounts to lying which is an offense under Section 137 according to Ranjha. He said that Khan is no longer Sadiq and Amin and should be disqualified from contesting elections for life under Article 62(1). (f), Article 2, Article 3 of the Constitution.
Ranjha said that Article 62(1)(f) is the same legal instrument that disqualified former Prime Minister Nawaz Sharif from contesting elections and removed him from power.
