The photo, taken at a courthouse in Georgia, shows Trump with his signature red tie, slicked-back hair and stern expression. This snapshot of his legal troubles now adorns T-shirts, mugs, shot glasses, posters, and even bobblehead dolls.

Pros and cons alike are taking advantage of the attention-grabbing image. Trump’s Save America Committee is selling “Never Surrender!” Mugshot t-shirts, mugs, and drink holders. Meanwhile, Trump’s son Don Jr. is marketing “Free Trump” merchandise. On the opposite side, the Lincoln Project, a Republican-founded anti-Trump group, is offering shot glasses with a brilliant acronym for Donald Trump’s critics.

Etsy, an online craft platform, offers a number of satirical items inspired by the mug shot, including a parody Taylor Swift concert T-shirt. A T-shirt store in Los Angeles is also getting in on the trend. The addition of merchandise has sparked debate, with some seeing it as a commercial move while others see it as a statement about Donald Trump’s legal challenges.

Political strategists believe that the image could raise significant funds for Trump’s campaign, especially for his fervent supporters. David Kuchel, a veteran Republican campaigner, highlighted the irony of celebrating an indictment through the sale of merchandise. Trump’s ongoing legal battles have been used to galvanize his base and fundraise. Campaigns reportedly make substantial profits from the sale of such merchandise.

However, the legal rights surrounding the use of mugshots for commercial gain are unclear. Although federal court mugshots are often public domain, state policies vary. Donald Trump’s campaign may have legal grounds to protect his image, but political parody material may offer some protection.

Trademark attorney Josh Griffin noted that due to the polarizing nature of Trump’s likeness, legal action may not be a priority. The controversy surrounding the mug shot mirrors Trump’s polarizing political career. Regardless of the legal complexities, the mugshot trade shows the intersection of commerce, politics, and public sentiment.
