ISLAMABAD: The Islamabad High Court (IHC) has dismissed terrorism charges against former prime minister and Pakistan Tehreek-e-Insaf (PTI) chairman Imran Khan over remarks against Additional Sessions Judge Zeba Chaudhry, Jee News reported Monday.
A two-judge bench headed by IHC Chief Justice Athar Minullah delivered the judgment – which was reserved earlier in the day – on a petition by PTI, which sought to dismiss the case. The court ordered that proceedings on other provisions of the case will continue in the relevant forum.
During the hearing, IHC Chief Justice Minullah inquired about the views given by the Joint Investigation Team (JIT) at the start of the case. On which the prosecutor referred to the JIT and said that the charges of terrorism are applicable to Imran Khan’s statement.
However, Imran Khan’s lawyer countered the arguments saying that there were some basic factors required to warrant terrorism charges which were not present in the case.
He argued that “a case of terrorism can be registered for creating an atmosphere of fear and terror, not for the possibility of creating such an atmosphere.”
The lawyer noted that the former prime minister talked about taking legal action and filing a case against the Inspector General of Police (IGP) and the Deputy Inspector General (DIG), arguing that those concerned should be prosecuted. Should have entered.
He said that there is a “mastermind” behind the computerized complaint against Imran Khan which is written with restraint.
After hearing the arguments of the parties, the Chief Justice of the IHC delivered the judgment and ordered the authorities to remove the provisions of the Anti-Terrorism Act (ATA) from the case.
It may be noted that PTI Chairman Imran Khan had obtained bail from the Anti-Terrorism Court (ATC) in a case where he was charged under the Terrorism Act for making threatening speeches against a woman judge and Islamabad police personnel. Charged under
The ATC granted interim bail to the PTI chairman till September 1 on a surety of Rs one lakh and directed him to appear before the court again.
A terrorism case was registered against Imran Khan at Margalla police station for using abusive language in his speech in Islamabad on August 20 and threatening Additional Sessions Judge Zeba Chaudhry.
