Appeal to Chief Justice against ‘illegal arrest’ of Fawad Chaudhry’s brother

The brother of Senior Vice President of Pakistan Tehreek-e-Insaf (PTI) Fawad Chaudhry has requested the Chief Justice of Pakistan (CJP) Justice Umar Atta Bandial to take automatic notice of his brother’s arrest on which the election has been threatened. The letter comes after the PTI leader was remanded in a sedition case – which has drawn criticism not only from his party but also from senior members of the government.

Faisal expressed fear that Fawad may be subjected to physical violence during police custody.

PTI leader’s brother Faisal Chaudhry, in his letter to the Chief Justice, argued that Fawad’s arrest in Lahore was illegal and made as if he was a terrorist.

Faisal said that the former federal minister needs the intervention of the Supreme Court to deliver justice.

Faisal also said that the Lahore High Court’s order regarding Fawad’s arrest was ignored.

“The Lahore High Court repeatedly ordered the police to produce Fawad Chaudhry, but the world saw how the court orders were mocked,” the letter said.

He said that powerful actors within the state did not listen to anyone as they handcuffed Fawad and took him out with a cloth covering his face.

The letter said that Fawad Chaudhry was handed over to the Islamabad Police instead of being produced in the Lahore High Court. He said that after judicial custody, Fawad Chaudhry was once again handed over to the police on physical remand.

He expressed fear that Fawad might face physical violence as had happened in the past. “I am writing to you as a lawyer about the illegal arrest of another lawyer,” he said.

Attaching a letter written by Fawad Chaudhry to his letter, Faisal requested the Chief Justice to consider it along with his appeal.

Fawad faces sedition charges.
Fawad – who is facing charges of sedition for allegedly “threatening” ECP members in public at a media talk – was arrested in Lahore on Wednesday after a case was registered against him at Islamabad’s Kohsar police station. He was arrested from his residence.

After the physical remand ended, he was produced in the court on Friday, but Judicial Magistrate Waqas Ahmed Raja rejected the prosecution’s request for extension. Later, the Sessions Court annulled the decision.

The same magistrate then sent him to two-day physical remand and ordered the police to produce him on Monday. Fawad is adamant that he will not retract his remarks, while his legal team has demanded that he be acquitted in the case.

Imran Khan also appealed to Chief Justice
Yesterday PTI Chairman Imran Khan had also written a letter to Chief Justice of Pakistan Bandial requesting to ensure that Fawad Chaudhry’s fundamental rights are not violated.

In his letter to the chief justice, the former prime minister mentioned that as the top judge is the guardian of the constitution, he requested him to “ensure that the honor and dignity of Fawad Chaudhry is not violated”.

The former prime minister referred to the “inhumane” treatment of Senator Azam Swati and PTI leader Shehbaz Gul while they were in the custody of law enforcement agencies (LEAs) – in two separate cases.

The PTI chief feared that the former information minister would be subjected to similar ill-treatment, in violation of Articles 9, 10A and 14, which protect the right to fair trial, freedom of expression and human dignity. Related to the violation. due to this happenings.
