ISLAMABAD: After the dismissal of Justice Aminuddin Khan, Justice Jamal Khan Mandukhel on Friday also recused himself from the Supreme Court bench hearing the Punjab and Khyber Pakhtunkhwa election delay case, after which the bench for the second consecutive time. has been dissolved.

Initially, a 5-member larger bench of the Supreme Court was constituted on Monday to hear the plea of Pakistan Tehreek-e-Insaf (PTI) against the delay in elections in Khyber Pakhtunkhwa and Punjab.

The initial bench included Chief Justice of Pakistan (CJP) Umar Atta Bandial, Justice Ijaz-ul-Ahsan, Justice Muneeb Akhtar, Justice Khan and Justice Mandukhel. He held three hearings on the matter.

However, on Wednesday, a Supreme Court bench headed by Justice Qazi Faiz Isa ordered the adjournment of cases under Article 184(3) of the Constitution pending amendments to the Supreme Court Rules, 1980 regarding discretionary powers of the Chief Justice. Formation of benches.

Justice Khan concurred with Justice Isa while Justice Shahid Waheed ruled 2-1 in the self-notice case of awarding 20 marks to Hafiz Quran students while taking admission in MBBS/BDS degree under Regulation 9(9). Consequently, the bench was dissolved on Thursday after Justice Khan recused himself from the case after the Supreme Court order stayed the proceedings under Article 184(3).

After the dissolution of the bench, the Supreme Court announced that the bench would continue hearing the case without Justice Khan.

But hours before the Supreme Court resumed hearing on Friday, the judgment was “overlooked” by Justice Isa in a circular.

Later, when the bench came to hear the case, Justice Mandukhel recused himself from the case.
